网易云音乐社区行为规范
为构建和谐、法治、健康的网络环境,维护网易云音乐的社区秩序,更好地保障用户合法权益,网易云音乐依据相关法规及政策要求,制定《网易云音乐社区行为规范》(“本规范”)。网易云音乐将根据《网易云音乐服务条款》、本规范以及网易云音乐不时发布的各类规则,对用户账号、用户行为和用户发布的内容等进行管理。
第一章 用户账号管理
第一条
用户注册和使用网易云音乐账号,应严格遵守《网易云音乐服务条款》的账号管理规则。
第二条
用户拥有设置个性化账号信息(包括:昵称、头像、个人介绍等)的权利,但不得设置含有以下内容的账号信息:
(一)违反国家法律法规的;
(二)包含人身攻击性质内容的;
(三)冒用关联机构或社会名人的;
(四)违规使用各种宗教类名称的;
(五)暗示与他人或机构相混同的;
(六)包含其他虚假、不良或非法信息的。
用户不得使用隐晦表达等方式规避以上限制。
第二章 用户行为及内容管理
第三条
网易云音乐鼓励用户验证真实身份及申请特定身份标识,包括申请个人认证、机构认证、申请成为网易云音乐达人等。认证用户应确保其申请认证的身份及材料真实、合法、有效,不得申请与其真实身份不符的认证身份,不得通过伪造材料、提供虚假信息获取认证身份。如用户/用户账号具有特定身份或属性(包括但不限于网易音乐人、MCN机构、社群管理员等)的,除遵守本规范外,还应遵守相应专项的协议、规则、政策等(具体以网易云音乐发布或公布为准,更多信息可点击《网易云音乐社区管理细则》查阅)。
第四条
网易云音乐鼓励用户制作、复制、发布含有下列内容的信息:
(一)宣传习近平新时代中国特色社会主义思想,全面准确生动解读中国特色社会主义道路、理论、制度、文化的;
(二)宣传党的理论路线方针政策和中央重大决策部署的;
(三)展示经济社会发展亮点,反映人民群众伟大奋斗和火热生活的;
(四)弘扬社会主义核心价值观,宣传优秀道德文化和时代精神,充分展现中华民族昂扬向上精神风貌的;
(五)有效回应社会关切,解疑释惑,析事明理,有助于引导群众形成共识的;
(六)有助于提高中华文化国际影响力,向世界展现真实立体全面的中国的;
(七)其他讲品味讲格调讲责任、讴歌真善美、促进团结稳定等的内容。
第五条
用户不得发布、传播、存储有以下内容的信息:
(一)反对宪法确定的基本原则的;
(二)危害国家安全,泄露国家秘密,煽动颠覆国家政权,破坏国家统一的;
(三)损害国家荣誉和利益的;
(四)歪曲、丑化、亵渎、否定英雄烈士事迹和精神,以侮辱、诽谤或者其他方式侵害英雄烈士的姓名、肖像、名誉、荣誉的;
(五)煽动民族仇恨、民族歧视,宣扬民族分裂主义,破坏民族团结,或者侵害民族风俗、习惯的;
(六)宣扬恐怖主义、极端主义或者煽动实施恐怖活动、极端主义活动的;
(七)违反国家宗教政策、利用宗教从事违法违规行为,或者违反宗教相关法律法规发布信息的;
(八)散布谣言,扰乱社会秩序,破坏社会稳定的;
(九)散布、宣扬淫秽、赌博、暴力、色情、凶杀、恐怖或者教唆犯罪的;
(十)煽动非法集会、结社、游行、示威、聚众扰乱社会秩序的;
(十一)侮辱或者诽谤他人,侵害他人名誉、隐私和其他合法权益的;
(十二)有法律、行政法规和国家规定禁止的其他内容的。
第六条
用户不得发布、传播、存储不安全信息、垃圾营销信息、不良信息、不实信息等。
(一)不安全信息,包括可能对用户财产安全或信息安全造成损失的信息,包括但不限于:
1. 含钓鱼网站链接的相关内容;
2. 含木马、病毒网站链接及相关内容;
3. 含潜在危险、窃取用户个人信息等相关内容;
4. 影响用户体验或被大量用户举报的未经审核的外链及其他多媒体等内容。
(二)垃圾营销信息,是指以营利为目的而发布的影响用户体验、扰乱网易云音乐社区秩序的信息,其中包括垃圾信息 、恶意信息和骚扰用户的营销信息,主要表现为:
1. 从事买卖粉丝、评论、投票及相关业务等;
2. 从事刷评论、刷转发、刷搜索、刷投票、刷有奖活动等业务;
3. 通过机器或软件等手段对他人大量发送广告信息;
4. 发送虚假中奖信息,或发布包含欺骗性外链的内容;
5. 利用账号封面图、账号头像、歌单封面等发布广告垃圾信息;
6. 利用歌单标题、歌单描述、播客名称、播客描述、播客内容、视频名称、视频描述、视频内容、节目名称、节目描述、节目内容、评论、转发、留言、私信等方式发布垃圾信息、广告信息等;
7. 利用系统漏洞干扰网易云音乐正常秩序的行为,如:盗用他人账号、强制他人关注、强制他人点赞等;
8. 使用特殊符号、图片等方式规避垃圾广告内容审核;
9. 通过人工方式或者技术手段实施流量造假、流量劫持以及虚假注册账号、非法交易账号、操纵用户账号等行为,破坏网络生态秩序;
10. 利用党旗、党徽、国旗、国徽、国歌等代表党和国家形象的标识及内容,或者借国家重大活动、重大纪念日和国家机关及其工作人员名义等,违法违规开展网络商业营销活动等,破坏网络生态秩序;
11. 发布其他影响用户体验或被大量用户举报的、平台认定其属于垃圾营销信息的内容。
(三)不良信息,包括淫秽色情信息、低俗信息、不当信息、对未成年人造成不良影响的信息等,包括但不限于:
1. 具体描绘性行为或露骨宣扬色情的信息;
2. 带有色情意味、暗示、挑逗和引起他人类似感受的音视频、文字、图片等信息;
3. 展现血腥、惊悚、残忍等致人身心不适的信息;
4. 与绯闻、丑闻、劣迹等相关的信息;
5. 宣扬低俗、庸俗、媚俗内容;
6. 不当评述自然灾害、重大事故等灾难的,如参与灾难、悲剧、刑事案件和逝世等话题讨论时有悖公序良俗、消费逝者的内容;
7. 美化、粉饰侵略战争行为的;
8. 恶搞国旗国徽、国家领导人等;
9. 危害未成年人人身安全和身心健康的内容,可能引发未成年人模仿不安全行为和违反社会公德行为、诱导未成年人不良嗜好等的内容。
10. 使用夸张标题,内容与标题严重不符的;
11. 煽动人群歧视、地域歧视等的;
12. 其他对网络生态造成不良影响的内容。
(四)不实信息,主要表现为:
1. 整体失实:事件本身系子虚乌有。
2. 捏造细节:捏造细节使整个事件被扭曲。
3. 夸大事实:在描述中对事实夸大其词,误导他人。
4. 过期信息:将已得到解决的事件作为新消息发布,并略去已产生的结果,误导他人。
5. 信息残缺:隐藏部分事实,以不完整的信息误导他人。
6. 断章取义:将部分事实加上推测作为事实发布,误导他人。
第七条
用户应当文明互动,理性表达,不得散布谣言,不得发布不尊重其他用户、对其他用户不友善的信息,包括但不限于贬低、诽谤、嘲讽、挑衅、羞辱、谩骂、歧视、威胁、侮辱他人的信息以及散布谣言。
用户应尊重他人隐私权和个人信息权益,不得侵害他人隐私或个人信息权益。除法律法规另有规定或经当事人同意的情况外,不得公布他人隐私或个人信息,包括但不限于真实姓名、照片、身份证号、电话号码、家庭住址及用户不愿公开的其他个人信息。用户不得通过发布、删除信息以及其他干预信息呈现的手段侵害他人合法权益或者谋取非法利益。
用户应尊重他人肖像权,未经他人同意不得擅自使用或修改其肖像。
用户应尊重他人安宁权,不得利用网易云音乐骚扰他人,不应以评论、@他人、私信等方式对他人反复发送重复、近似、诉求相同的信息。反复指三次及以上。
用户应对其所上传、发布的文字、图片、音视频等内容的知识产权负责,不得侵犯他人知识产权,不得抄袭,转发他人在网易云音乐发布的原创内容应注明出处。
用户不得利用深度学习、虚拟现实等新技术新应用从事法律、行政法规禁止的活动。
第三章 社区管理方式
第八条
网易云音乐可通过主动发现及接受用户举报发现违规行为。用户可使用网易云音乐的举报功能,对涉嫌违反本规范的行为和用户进行举报。
网易云音乐有权基于自身判断,认定用户行为是否违反本规范。
第九条
违规处理方式:网易云音乐有权采取内容处理手段和账号处理手段,对违规账号和违规行为进行处理,有权保留相关记录并向政府主管部门进行报告。
内容处理手段包括:及时删除、屏蔽、断开链接或采取其他合理措施消除或停止传输违规的评论、私信、歌单、动态、音视频、直播信息及用户头像、个人资料等内容。
账号处理手段包括:不予注册账号(包括禁止重新注册账号),警示提醒,禁言,封禁,关闭/注销账号、回收账号,列入黑名单及其他处理手段(如限制账号功能、暂停信息更新、停止广告发布等)。其中,禁言是指在禁言期间禁止使用具有信息发布属性的服务或功能,包括但不限于不得发布、回复、创建、修改任何评论、动态、私信、歌单、音视频、直播信息及用户头像、个人资料等,以及不得使用日推精灵、AI绘画师等附带功能,但可正常登录网易云音乐,禁言期间结束后账号将恢复正常使用;封禁是指在封禁期间被封禁账号无法登陆和使用网易云音乐所有服务,封禁期间结束后账号将恢复正常使用。网易云音乐有权视违规账号的具体情况确定禁言、封禁的具体期间,包括但不限于3天、7天、15天、30天、永久等。如用户被禁言次数较多、不予改正的,账号将直接被封禁或永久封禁。
第十条
网易云音乐有权依据相关法律法规、《网易云音乐服务条款》及本规范制定并发布《网易云音乐社区管理细则》,并依法依规对用户违规行为进行处理。
用户如对处理措施有异议的,可通过网易云音乐官网“意见反馈”或网易云音乐移动客户端“我的客服”渠道进行申诉。
第四章 附 则
第十一条
网易云音乐可根据互联网及自身平台的不断发展,随着社区管理经验的不断丰富,出于维护网易云音乐社区秩序的目的,不断完善本规范。
第十二条
本规范自2015年4月1日起公布并施行,于2021年4月30日、2022年2月25日、2022年12月21日修订。

Community Code of Conduct
According to and implementing the spirit of the document Decision of the Standing Committee of the National People's Congress on Strengthening Network Information Protection, NetEase Cloud Music develops this Convention together with users, to create a harmonious, legal and healthy Internet environment, maintain the community order of NetEase Cloud Music and better guarantee users’ legal rights and interests.
Chapter I General
Article 1
NetEase Cloud Music is an online platform created and run by NetEase (hereinafter referred to as “the Platform”).
Article 2
NetEase Cloud Music users are registered users of NetEase Cloud Music who shall act according to this Convention; those unregistered shall also follow this Convention when acting on the Platform.
Article 3
NetEase Cloud Music users shall not breach existing laws and regulations when acting on the Platform. The Platform will, in accordance with related laws and regulations and the User Registration Agreement, in collaboration with judicial authorities, maintain the legal rights and interests of the infringed.
Article 4
According to existing laws and regulations and this Convention, NetEase Cloud Music Community Management Regulations (Trial) is prepared and managed by NetEase Cloud Music Community Management Center (hereinafter referred to as “the Center”).
Chapter II Users’ Rights
Article 5
Users have the right to use their respective accounts of NetEase Cloud Music. The right shall not be transferred in any way. Any act under his or her account shall be considered the act of the registered user.
Article 6
The Center encourages users to verify their real identities and apply for specific identification. The application mode and review conditions are open and transparent. Such users are entitled to more services. Specific identification includes personal authentication, NetEase Cloud Music gurus and agency authentication.
Article 7
Users’ expressions on the Platform shall neither infringe others’ legal rights and interests, nor be in conflict with existing laws and regulations and this Convention.
Article 8
Users’ personal privacy shall be protected.
NetEase Cloud Music users’ information shall be preserved by a third-party platform. Protecting users’ privacy is NetEase Cloud Music’s basic policy, except to the extent that it is made public by users or required by judicial authorities to be disclosed according to legal procedures.
Article 9
Users may maintain their legitimate rights and interests on NetEase Cloud Music by the report function of NetEase Cloud Music or judicial means when such rights and interests are violated.
Chapter III Code of Conduct
Article 10
Users shall sign up and use NetEase Cloud Music according to existing laws and regulations. No user shall grant others the right to use his or her account of NetEase Cloud Music in any way or embezzle others’ accounts.
Article 11
Except as officially approved by NetEase Cloud Music, users shall not mala fide sign up for a NetEase Cloud Music account, release contents or follow others by machine or software or those other than manual means.
Article 12
Users have the right to set personalized account information (including nickname, avatar, personal profile, etc.), but shall not set the account information which:
(1) breaches national laws and regulations;
(2) contains the contents of personal attacks;
(3) implies the same as others or organs;
(4) contains other illegal information.
The above restrictions shall not be evaded by obscure expressions or otherwise.
Article 13
Users have the right to post information, but shall not post the information which:
(1) goes against the basic principles determined by the Constitution;
(2) damages national unity, sovereignty and territorial integrity;
(3) discloses national secrets, or endangers national security, or damages national honor and interests;
(4) incites ethnic hatred or ethnic discrimination, or undermines ethnic unity, or damages ethnic customs or habits;
(5) damages national religious policy, or propagates cults or superstitions;
(6) spreads rumors, or disturbs social order, or damages social stability;
(7) propagates obscenity, gambling, violence, pornography, homicide, terror, or instigate crimes;
(8) incites unlawful assembly, association, parades, demonstrations, or gathers crowds to disturb social order;
(9) contains any other content prohibited by laws, administrative regulations and national provisions.
Article 14
Users shall not post hazardous or insecure information, marketing spams, obscene, pornographic or false information etc. (see Article 30, Chapter V herein for details).
Article 15
Users shall respect others’ right of reputation, and shall not attack others by insult, defamation or otherwise.
Article 16
Users shall respect, and shall not infringe others’ privacy, except to an extent that it involves public interests or is approved by the party concerned. Privacy shall include the real name, ID number, phone number, family address and other personal information which users are unwilling to make public.
Article 17
Users shall respect others’ right of portrait, and shall not use or revise others’ portraits without their consent.
Article 18
Users shall respect others’ right of tranquility, and shall not harass others by using NetEase Cloud Music, including sending repeated or similar information or information about the same demand to others again and again through comments, @ others or private messages.
Article 19
Users shall respect others’ copyright. To post others’ original contents, users shall indicate the source or there shall be a noticeable repost mark.
Article 20
Users shall ensure the authenticity, legitimacy and validity of identities and materials required for authentication application.
Chapter IV Community Management
Article 21
NetEase Cloud Music community management shall be completed by the Center.
Article 22
The Center may discover violations by itself and accepting users’ report. Users may use the report function of NetEase Cloud Music. Disputes over personal rights like the rights of name, reputation, honor, portrait and privacy shall be settled according to the related procedure of NetEase.
Article 23
The Center deals with violations according to the NetEase Cloud Music Community Management Regulations (Trial).
Article 24
Violation handling includes content handling and account handling.
Content handling includes deletion of comments, playlists, posts, etc.
Account handling includes interaction ban and account ban. Interaction ban means users are banned from delivering any post or private message for 3, 7 or 15 days as the case may be, during which they may log in to NetEase Cloud Music and after which the account will resume normal service; account ban means users can neither log in to a banned account nor use all services of NetEase Cloud Music. If a user is banned frequently from interaction and fails to correct, his or her account will be directly banned.
Article 25
Clearly identifiable violations or violations reported by other users shall be directly handled upon determination by the Center.
Article 26
The Center will decide any alleged violation by majority rule within a specified period, and deal with it based on the decision.
Chapter V Supplementary Provisions
Article 27
NetEase will not be liable for any legal dispute arising from users’ behaviors on NetEase Cloud Music.
Article 28
Laws and regulations herein refer to the existing laws and regulations of mainland China. In case of any conflict between this Convention and such laws and regulations, such laws and regulations shall prevail.
Article 29
In order to maintain the NetEase Cloud Music community order, the Center may, with the increase of experience in community management, constantly improve this Convention in different stages of Internet development.
Article 30
Hazardous and insecure information, marketing spams, and obscene, pornographic and false information are detailed.
Article 31
No hazardous information shall be posted. Hazardous information mainly includes:
(I) those which endanger national and social security according to existing laws and regulations (“Sensitive Information”), including those which:
1. go against the basic principles determined by the Constitution;
2. endanger national unity, sovereignty and territorial integrity;
3. disclose national secrets, or endanger national security, or damage national honor and interest;
4. incite ethnic hatred or ethnic discrimination, or undermine ethnic unity, or damage ethnic customs or habits;
5. damage national religious policy, or propagate cults or superstitions;
6. spread rumors, or disturb social order, or damage social stability;
7. propagate gambling, violence, homicide, terror, or instigate crimes;
8. incite unlawful assembly, association, parades, demonstrations, or gather crowds to disturb social order;
9. contain any other content prohibited by laws, administrative regulations and national provisions.
(II) Insecure information refers to those which may cause the loss of users’ property or information, including those which:
1. contain phishing site links;
2. contain Trojan and virus site links and the like;
3. contain potential danger, or cause users’ privacy data to be stolen;
4. contain un-reviewed external links and other multimedia contents which affect user experience or are reported by many users;
(III) Marketing spams refer to the information and conduct generated in the process of building or maintaining a relationship with users for profit-making purposes, which affect user experience and disturb the NetEase Cloud Music community order, including spams, malicious acts and the marketing information that harasses users, evidenced by:
1. buying and selling followers, comments and votes, and engaging in related business;
2. increasing comments, shares, searches, votes and events providing awards by improper means;
3. sending advertising information to others’ pages by machine or software or those other than manual means;
4. false winning information;
5. posting spams and obscene and pornographic information with account covers, account photos or playlist covers, or spoofing the national flag or national leaders;
6. posting spams by using the titles and descriptions of playlists, names and descriptions of stations and programs, comments, shares, messages and private messages;
7. disturbing the normal order of NetEase Cloud Music by exploiting system bugs, such as embezzling others’ accounts and forcing others to follow;
8. marketing information, characterized by advertising and promotion, which affects user experience or is reported by many users.
(IV) Obscene and pornographic information, including:
1. Obscene information: specific descriptions of sexual behavior or explicit pornography.
2. Pornographic information: nude photos, audios and text which mean and imply eroticism, feature flirtation, and cause others to have a similar feeling.
Article 32
No false information shall be posted. False information is evidenced by:
(1) Overall inconsistency with facts: an event is non-existent.
(2) Fabricated details: details are fabricated to distort an event.
(3) Exaggerated facts: facts are exaggerated in the process of description to mislead others.
(4) Outdated information: resolved events are posted as the latest news, and generated results are omitted.
(5) Incomplete information: facts are hidden in part, and incomplete information is used to mislead others.
(6) Garble: a part of a fact plus speculation is posted as a fact. This shall not apply to literary criticism.
Article 33
Violations related to user disputes, including:
(1) Plagiarizing contents, evidenced by posting others’ original contents without indicating the source or the repost mark. Original contents temporarily refer to those posted initially on NetEase Cloud Music, excluding revised and integrated information etc.
(2) Harassing others, evidenced by sending repeated or similar information or information about the same demand to others again and again through comments, @ others or private messages.
(3) False user identity through authentication, evidenced by:
1. obtaining the authenticated identity on NetEase Cloud Music by forging materials and providing false information;
2. inconsistency between a user’s real identity and the authenticated one.
(4) the fact that a user’s identity is true through authentication, but there is any violation in the process of undertaking a commercial activity on NetEase Cloud Music, which will be handled according to related provisions. A commercial activity means posting advertising information on NetEase Cloud Music.
Article 34
This Convention shall take effect from April 1, 2015.
This Convention is updated on April 1, 2015.
